FurBabySit LLC — Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a binding agreement between you (“User,” “you,” or “your”) and FurBabySit LLC (“FurBabySit,” “we,” “us,” or “our”), a limited liability company registered in the States of Florida and Georgia. By creating an account, accessing, or using the FurBabySit platform, mobile application, or related services (collectively, the “Platform”), you agree to be bound by these Terms and all applicable laws and regulations.
If you do not agree to these Terms, do not access or use the Platform.
2. Nature of the Platform
FurBabySit is a marketplace technology platform that connects independent pet care providers (“Sitters”) with individuals seeking pet care services (“Pet Parents”).
FurBabySit does not provide pet-sitting, boarding, walking, or any other pet care services directly, and is not a party to any agreement between Pet Parents and Sitters. Sitters are independent contractors who control their own rates, schedules, and service methods. FurBabySit does not supervise, direct, or control Sitters, and disclaims any responsibility for the quality, timing, or outcome of services performed.
3. Account Registration and Eligibility
To access the Platform, users must create an account and maintain accurate, current information. Users must be at least 18 years of age and legally capable of entering into binding agreements.
FurBabySit may suspend or terminate accounts at its discretion for policy violations, safety concerns, fraudulent activity, or the provision of false information.
4. Screening and Verification Policy
FurBabySit is committed to maintaining a trusted community.
All Sitters and Pet Parents must consent to an initial background check prior to activation and to annual re-verifications thereafter.
Refusal or failure to consent to re-verification within 30 days of notification will result in automatic account termination.
Accounts may be suspended or removed immediately if new criminal information arises that violates FurBabySit’s standards or policies.
Background checks are conducted by third-party vendors such as Checkr.
By maintaining an active account, users authorize FurBabySit and its screening partners to conduct onboarding and periodic background checks as necessary to uphold platform safety.
5. Payments and Fees
5.1 Payment Processing
All financial transactions on the Platform are processed through Stripe, a third-party payment processor.
FurBabySit does not directly hold user funds but may instruct Stripe to pause, release, or reverse payments as necessary to resolve disputes, conduct investigations, or ensure compliance with Platform policies.
5.2 Conditional Payouts
Sitters acknowledge that payouts are conditional upon:
Completion of services as agreed with the Pet Parent; and
Compliance with FurBabySit’s Terms, Trust & Safety Policy, and applicable law.
FurBabySit reserves the right to delay, withhold, or reverse payouts if it determines, in its discretion, that a violation occurred, a refund is warranted, or further investigation is required.
5.3 Service Fees
FurBabySit may deduct platform service fees from transactions to support payment processing, background checks, and operational costs. Fees are disclosed prior to booking and are non-refundable unless expressly stated otherwise.
6. Refunds and Disputes
Refunds are handled on a case-by-case basis following investigation.
Pet Parents are responsible for reviewing a Sitter’s individual cancellation policy before booking. Sitters forfeit payment if they cancel a confirmed booking.
Disputes concerning refunds or cancellations must be submitted through the Incident Report Form available on the Platform.
7. Non-Solicitation and Off-Platform Policy
Users agree not to solicit, accept, or arrange services or payments outside the Platform with individuals they first connected with through FurBabySit.
All communications, bookings, and payments must be conducted through the Platform.
Engaging in off-platform transactions, or encouraging others to do so, constitutes a material breach of these Terms and may result in immediate account termination.
FurBabySit is not responsible for any incidents, disputes, or losses arising from off-platform interactions.
8. Content and Intellectual Property
Users may post or upload text, photos, reviews, or other materials (“User Content”).
By submitting User Content, you grant FurBabySit a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute that content for Platform operation, marketing, and promotional purposes.
Users who do not wish their content to be used for promotional purposes may opt out by emailing support@furbabysit.com
with a written request.
All Platform content, including trademarks, logos, and software, is the exclusive property of FurBabySit and may not be copied, modified, or distributed without prior written consent.
9. User Responsibilities
Users agree to:
Provide truthful, accurate, and complete information.
Comply with all applicable laws and FurBabySit policies.
Refrain from abusive, harmful, or fraudulent conduct.
Report safety concerns promptly via the Incident Report Form.
Knowingly submitting false or misleading information may constitute fraud under state law and will result in account removal and potential referral to authorities.
10. Liability Limitation
To the fullest extent permitted by law, FurBabySit’s total liability arising out of or relating to any booking or use of the Platform shall not exceed the total amount paid for the booking in question or $500, whichever is less.
FurBabySit shall not be liable for:
Loss of pets, property damage, injury, or illness resulting from Sitter or Pet Parent actions;
Any indirect, incidental, special, or consequential damages; or
Events beyond its reasonable control.
Users acknowledge that pet care inherently involves risk and that FurBabySit is not responsible for acts or omissions of Sitters or Pet Parents.
11. Mutual Indemnification
Each party agrees to indemnify, defend, and hold harmless the other party and its affiliates from any claims, losses, or expenses arising from their actions or omissions in connection with the Platform.
This includes, without limitation, any claim relating to bodily injury, property damage, or violation of law.
12. Dispute Resolution and Arbitration
Before initiating arbitration, users must first contact FurBabySit Support within 30 days of the event giving rise to the dispute to allow for informal resolution.
If the dispute cannot be resolved, it shall be settled by binding arbitration on an individual basis under the rules of the American Arbitration Association.
Arbitration proceedings shall take place in, and be governed by the laws of, the State of Florida, regardless of the user’s residence.
Either party may bring an eligible claim in small claims court in lieu of arbitration.
If FurBabySit’s principal place of business changes to another state, FurBabySit may update the governing law and arbitration venue accordingly, with notice to users.
13. Termination
FurBabySit reserves the right to suspend or terminate any account at its sole discretion for safety concerns, policy violations, fraudulent activity, or other misuse.
Termination does not limit FurBabySit’s right to seek other remedies as permitted by law.
14. Modifications to Terms
FurBabySit may update these Terms periodically. The “Last Updated” date at the top of this page reflects the latest revision.
Continued use of the Platform after notice of changes constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full effect.
16. Entire Agreement
These Terms, together with FurBabySit’s Privacy Policy, Refund & Cancellation Policy, Trust & Safety Policy, and any incorporated addenda, constitute the entire agreement between you and FurBabySit regarding Platform use.
